The rules and guidelines for using AGNI Browser

Introduction

These Terms of Service ("Terms") govern your access to and use of AGNI Browser ("Browser" or "Services") provided by Bhoomy Informatics ("we", "our", or "us"). By downloading, installing, or using AGNI Browser, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use AGNI Browser.

License to Use AGNI Browser

Grant of License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use AGNI Browser for your personal or internal business purposes.

Open Source

AGNI Browser is open-source software licensed under the MIT License. You may view, modify, and distribute the source code in accordance with the MIT License terms. However, these Terms of Service govern your use of the compiled browser application.

Acceptable Use

Your Responsibilities

When using AGNI Browser, you agree to:

  • Comply with these Terms and all applicable laws and regulations
  • Use the Browser only for lawful purposes
  • Not use the Browser to violate the privacy rights of others
  • Not attempt to gain unauthorized access to our systems or services
  • Not use the Browser to distribute malware, viruses, or other malicious software
  • Not circumvent any security features of the Browser
  • Respect the intellectual property rights of others

Prohibited Activities

You may not:

  • Use the Browser for any illegal activities
  • Attempt to reverse engineer, decompile, or disassemble the Browser (except as permitted by the open-source license)
  • Use the Browser to harm minors in any way
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Browser or servers
  • Use automated means to access the Browser except through approved APIs

Web3 and Blockchain Features

Wallet Functionality

AGNI Browser includes Web3 wallet capabilities. You acknowledge and agree that:

  • You are solely responsible for securing your private keys and seed phrases
  • We do not have access to your private keys or cryptocurrency funds
  • Lost or stolen private keys cannot be recovered by us
  • Cryptocurrency transactions are irreversible
  • You are responsible for understanding the risks of cryptocurrency use
  • We are not responsible for any financial losses resulting from your use of Web3 features

Decentralized Storage

When using IPFS, Arweave, Filecoin, or other decentralized storage features:

  • Content may be permanent and irreversible once published
  • You are responsible for the content you publish or pin
  • Third-party storage networks have their own terms and policies
  • We do not control or monitor content on decentralized networks

Updates and Modifications

Browser Updates

We may release updates, patches, or new versions of AGNI Browser. You agree that we may automatically update the Browser on your device. You can disable automatic updates in the settings, but doing so may expose you to security vulnerabilities.

Changes to Terms

We reserve the right to modify these Terms at any time. The updated version will be effective when posted, and your continued use of AGNI Browser after any changes indicates your acceptance of the updated Terms. We will provide notice of material changes through the Browser or by other means.

Privacy and Data

Your use of AGNI Browser is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our privacy practices.

Intellectual Property

Our Intellectual Property

The AGNI Browser name, logo, and branding are trademarks of Bhoomy Informatics. You may not use our trademarks without our prior written permission, except as permitted by the open-source license for attribution purposes.

User Content

You retain all rights to content you create, store, or transmit using AGNI Browser. We do not claim ownership of your content, including your browsing data, bookmarks, or Web3 transactions.

Third-Party Services and Content

AGNI Browser may provide access to third-party websites, services, and content. We do not control or endorse these third parties and are not responsible for their content, products, services, or practices. Your interactions with third parties are solely between you and them.

Some features may require third-party services (e.g., blockchain nodes, IPFS gateways). These services have their own terms and privacy policies that apply to your use.

Extensions and Add-ons

If you install extensions or add-ons in AGNI Browser:

  • Extensions are provided by third-party developers
  • We are not responsible for extension functionality or security
  • Extensions may have their own terms and privacy policies
  • You install extensions at your own risk
  • We reserve the right to remove malicious extensions

Disclaimers and Limitations of Liability

Disclaimers

AGNI BROWSER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Browser will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Browser is free of viruses or other harmful components
  • Results from using the Browser will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BHOOMY INFORMATICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE AGNI BROWSER.

This includes damages related to:

  • Loss of cryptocurrency or digital assets
  • Unauthorized access to your wallet or accounts
  • Data loss or corruption
  • Security breaches or vulnerabilities
  • Third-party content or services

Our total liability to you for any claims arising from your use of AGNI Browser shall not exceed the amount you paid us in the past 12 months (which is $0 for free users).

Indemnification

You agree to indemnify, defend, and hold harmless Bhoomy Informatics and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of AGNI Browser
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

Termination

You may stop using AGNI Browser at any time by uninstalling it from your device. We reserve the right to suspend or terminate your access to any online features or services associated with the Browser if you violate these Terms or for any other reason.

Upon termination:

  • Your license to use AGNI Browser terminates
  • You should uninstall the Browser from your devices
  • Certain provisions of these Terms will survive (including disclaimers, limitations of liability, and dispute resolution)

Dispute Resolution

Informal Resolution

If you have a dispute with us, please contact us first at legal@agnibrowser.com or legal@bhoomy.in to attempt to resolve it informally.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Ahilyanagar, Maharashtra, India.

Arbitration

For disputes that cannot be resolved informally, you agree to resolve them through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Ahilyanagar, Maharashtra, India, in the English language.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding AGNI Browser and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet service provider failures.

Export Control

AGNI Browser may be subject to export control laws. You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country subject to a government embargo or designated as a "terrorist supporting" country.
